PUBLIC NOTICE
In accordance with Section 401 of the Clean Water Act, 33 U.S.C. § 1341, the Arkansas Department of Energy and Environment (E&E), Division of Environmental Quality (DEQ), Office of Water Quality, gives the following notice:
Kevin Weston has requested a 401 Water Quality Certification from DEQ for a streambank restoration project on the Eleven Point River. The Eleven Point River has been designated as an Outstanding Resource Water in 8 C.A.R pt 21, Surface Water Quality Standards. The project is located south of Dalton (36.37003, -91.11886) in Randolph County, Arkansas.
Citizens wishing to examine or obtain copies of the application for the activity may do so at E&E headquarters, located at 5301 Northshore Drive, North Little Rock, AR 72118-5317. To request a copy of one or more of the documents, please call (501) 682-0663 or email ee.instreamactivityinfo@arkansas.gov.
Comments on the proposed activity will be accepted in accordance with 8 C.A.R § 11-208. DEQ’s contact for submitting written comments on the proposed activity, or making inquiries concerning the project, is the Office of Water Quality Planning Branch at the above mailing address, email address, or telephone number. Please reference Submission ID HQQ-GSXZ-CHYVP when requesting information pertaining to this project.
The period for submitting comments on the proposed activity shall begin on the date of publication of the public notice and end at 5 p.m. (Central Standard Time) on the 30th day after the publication date. If the last day of the comment period is a Saturday, Sunday, or legal holiday, the public comment period shall expire on the next day that is not a Saturday, Sunday, or legal holiday. All persons, including the applicant, who wish to comment on the proposed activity must submit written comments to DEQ, along with their name and mailing address.
Only those who submit written comments during the 30-day comment period or who make comments for the record at a formal public hearing regarding this proposed permit will have legal standing to appeal any final permitting decision made by DEQ. Appeals must conform to all the requirements set forth in applicable laws and regulations.
