COMMISSIONER’S SALE
NOTICE IS HEREBY GIVEN, that in pursuance of the authority and directions in the Default Judgment and Decree of Foreclosure made and entered on the 15th day of June, 2026, in a certain cause of the Circuit Court of Conway County, Arkansas (Case No. 15CV-26-141), then pending between First Financial Bank, Plaintiff, and Defendants Cumi Tran and Alma Espalarga Soriano Tran, the undersigned, as Commissioner of said Court, will offer for sale at public venue to the highest bidder, on the 2nd floor of the Conway County Courthouse, located at 115 S. Moose Street, Morrilton, Arkansas 72110, within the hours prescribed by law for judicial sales, on the 14th day of July, 2026, beginning at 10:00 a.m., the following-described real property and additional collateral located in Conway County, Arkansas, to-wit:
A part of the S1/2 of the NE1/4 of Section 9, T5N, R19W, of the Fifth P.M., Conway County, Arkansas, and more definitely described as follows: Begin at the Northwest Corner of said S1/2 of the NE1/4 and run S00°43’14”W along forty line 1,323.61 feet to the Southwest Corner of the said S1/2 of the NE1/4; thence S86°50’46”E along forty line 2,667.61 feet to the Southeast Corner of the said S1/2 of the NE1/4; thence N63º38’18”W 72.47 feet; thence N87º26’59”W 559.67 feet; thence N87º47’04”W 84.54 feet to the center of a road; thence along the centerline of the road the following courses: N62º51’33”W 140.11 feet; N60º06’45”W 474.76 feet; N63º01’54”W 278.59 feet; N50°07’57”W 88.53 feet; N40°38’25”W 93.19 feet; N49°49’38”W 211.72 feet; N45°02’36”W 108.94 feet; N56°24’04”W 74.57 feet; N69º05’36”W 116.04 feet; N61º06’01”W 135.48 feet; N62°07’12”W 475.32 feet; N49°14’51”W 42.24 feet; N25°41’02”W 49.67 feet; N06°45’52”W 45.97 feet; N00°08’30”E 84.23 feet; N14º45’50”W 71.84 feet to the point of beginning, containing 25.80 acres, more or less. Less and Except land in the Southwest part of the 25.80-acre description, being all that part South and West of the existing Saddler Bend County Road, estimated 1.8 acres, more or less, in Section 9, Township 5 North, Range 19 West, in Conway County, Arkansas.
This real property is located at 299 HWY 247, Casa, Arkansas 72025 (the “Real Property”).
Additional Collateral:
(1) All equipment, including but not limited to, all machinery, vehicles, furniture, fixtures, manufacturing equipment, farm machinery and equipment, shop equipment, office and recordkeeping equipment, and parts and tools;
(2) All existing and future contracts, and all payments and proceeds therefrom, to provide housing and daily care for chickens, turkeys, other poultry, and swine, including without limitation, the agreement between Defendants and Wayne Farms dated November 27, 2024, and all extensions, modifications, and replacements thereof;
(3) Including but not limited to: 96 KW Stateline Generator W/Perkins Engine Serial #0138604101 and 1998 CAPH Mobile Home VIN#CHVM169868014002 (collectively, the “Additional Collateral”). The Mobile Home may be referred to separately as the “Mobile Home.”
TERMS OF SALE: The sale is “as is where is” without any warranty whatsoever. The purchaser will be required to pay ten percent (10%) of the successful bid in cash, non-refundable, before 3:00 p.m. on the day of the sale, and post a bond acceptable to First Financial Bank and the Commissioner with approved security to secure the payment of the purchase price, and such bid shall accrue interest at the lawful rate from date of sale until paid within three (3) months after the date of sale and a lien being retained on the Real Property and the Additional Collateral, including the Mobile Home, to secure payment of the purchase amount; provided that if First Financial Bank becomes the purchaser at the sale for an amount not in excess of the judgment and costs herein, in lieu of giving bond, it may credit the amount of the bid less the costs of this proceeding, including the Commissioner’s fee, upon the judgment. The Commissioner, at its sole discretion, may sell the Real Property and the Additional Collateral as one lot, that is, one bid will include the offer to purchase both the Real Property and the Additional Collateral, including the Mobile Home.
