FORECLOSURE SALE
NOTICE IS HEREBY GIVEN that the undersigned Commissioner of Sharp County, Arkansas, pursuant to the Foreclosure Decree, Judgment, and Order of Delivery of the Circuit Court of Sharp County, Arkansas, which was filed with the Clerk on or around May 27, 2026, in this matter, in which Stone Bank is Plaintiff and Craig Lee Pencil and Brittnee Nicole Pencil are Defendants, will at 10:15 a.m. on the 18th day of June, 2026, in the main lobby of the Sharp County Courthouse in Ash Flat, Sharp County, Arkansas, offer for sale at public auction to the highest and best bidder the following land situated in the County of Sharp, State of Arkansas:
A part of the NE 1/4 of the NE 1/4 of Section 26, Township 16 North, Range 4 West, of the 5th P.M., Sharp County, Arkansas, described as follows: Commence at the SE corner of the NE 1/4 of Section 26; thence North on Section line 20.45 chains; thence West 14.65 chains, thence North 535.32 feet to the centerline of private drive and the point of beginning; thence continue North 474.44 feet to the centerline of the Mize/Campbell Road; thence meandering with said road in a southeasterly direction approximately 481.0 feet to the centerline of a private drive; thence meandering with said private drive in a Southwesterly direction, back to the point of beginning.
ALSO:
A parcel of land lying in the NE 1/4 of Section 26, Township 16 North, Range 4 West of the 5th P.M. Sharp County, Arkansas, being described as follows: Commencing at the SE corner of the NE 1/4 of Section 26; thence North on Section line 20.45 chains; thence West 14.65 chains to the point of beginning; thence North 20.45 chains to the North line of said Section; thence West on the Section line 14.74 chains; thence South 12.5 degrees East 3.32 chains; thence South 70 degrees West 4.5 chains; thence South 56.5 degrees West 3.55 chains; thence South 49.5 degrees West 2.77 chains; thence South 40.5 degrees West 0.82 chains; thence South 68 degrees West 2.0 chains to the West Boundary line of the NE 1/4 of said Section; thence due South 13.5 chains; thence South 85.5 degrees East 4.3 chains; thence South 4.5 degrees East 3.6 chains; thence North 84.5 degrees East 21.5 chains; thence North 4.85 chains, back to the point of beginning.
LESS AND EXCEPT:
All that part of the above described legal that lies North of the centerline of Mize/Campbell Road, as now located.
ALSO, LESS AND EXCEPT:
A part of the NW 1/4 of the NE 1/4 in Section 26, Township 16 North, Range 4 West of the 5th P.M., described as follows: Commence at the NW corner of said NW 1/4 NE 1/4 and run South along the West line thereof to a point on the South right of way of a road intersecting said West line for the point of beginning of the tract herein conveyed; thence continue South along said West line a distance of 989.31 feet; thence East 440.0 feet; thence North to the South right of way of Mize/Campbell road; thence running Southwesterly along said right of way of said road to the point of beginning.
(collectively, “Real Estate”).
TERMS OF SALE: The foreclosure sale of the Real Estate is subject to all existing liens for accrued and unpaid property taxes or assessments on the Real Estate. The foreclosure sale of the Real Estate shall be for cash or on a credit of three (3) months. If the Real Estate is purchased on credit, the purchaser is required to give bond as required by law and this Court, with approved security, bearing interest at the maximum legal rate per annum from date of sale until paid, and a lien will be retained on the Real Estate sold to secure payment of the purchase price; provided that if Plaintiff purchases the Real Estate at the foreclosure sale for an amount not in excess of the judgment, attorney fees, and costs then owed, in lieu of giving bond, Plaintiff may credit the amount of its bid, less the costs of this proceeding, including the Commissioner’s fee, upon the judgment, attorney fees, and costs herein owed, at the time of the confirmation of such sale, which credit will be an extinguishment of the judgment, attorney fees, and costs herein owed to the extent of such credit.
