NOTICE IS HEREBY GIVEN that on October 22, 2026, at or about 12:00PM, the following real property will be sold at the front door of the Jackson County Courthouse, Courthouse, 208 Main St, Newport, AR 72112 to the highest bidder for cash:
Lot 5, Block 7, Trivista Terrace Addition to the City of Newport, Jackson County, Arkansas, according to the plat and bill of assurance of said Trivista Terrace Addition, dated June 11, 1948 and filed in the office of the recorder of Jackson County, Arkansas, and duly recorded in Record Book 99, Page 564, and being part of the Southeast Quarter of Section 2, and part of the Southeast Quarter of Section 2, and part of the Northeast Quarter of the Northeast Quarter of Section 11, Township 11 North, Range 3 West.
More Commonly Known As: 705 Holden Ave., Newport, AR 72112
On February 8, 2023, Chase Dylan Allen, an unmarried man, executed a Mortgage in favor of Mortgage Electronic Registration Systems, Inc. as nominee for DAS Acquisition Company, LLC, which was recorded on February 9, 2023, as ID: R-2023-0233 in the real estate records of Jackson County, Arkansas, now held by Newrez LLC. Default by the current owner(s) of the property has occurred in the payment of the note, indebtedness and trust property secured by said Mortgage, and the same is now wholly due and owing to the holder of said debt. Mortgagee intends to sell the above trust property to satisfy the obligation. The default for which the foreclosure is made occurred on November 1, 2025.
Tenants may exist that claim an interest in the real property described herein.
The undersigned is the Attorney-in-Fact for the Mortgagee and is acting on and with the consent of the Mortgagee who is exercising its power of sale under Ark. Code Ann. Section 18-50-115 which implies a power of sale in every mortgage of real property situated in this State that is duly acknowledged and recorded.
This sale is subject to any requirements and conditions set forth in any applicable recorded or unrecorded plat or bill(s) of assurance affecting the above real property; any restrictive covenants, easements, set back lines or encroachments; any unpaid and/or delinquent taxes or special assessments; any statutory redemption rights of any governmental entity; any prior liens or encumbrances as well as any priority created by a UCC or fixture filing; and, to any matter that an accurate survey of the property might disclose. This property is being sold “as is” with no representation as to the condition of any structure(s) thereon or the accuracy of the above legal description. The purchaser at the sale shall be solely responsible for payment of all transfer taxes, deed revenue stamps and deed recording fees.
