NOTICE OF SALE
Notice is hereby given that the undersigned Commissioner appointed by the Circuit Court of Marion County, Arkansas in cause No. 45CV-25-139 will offer for public sale the following described lands lying in Marion County, Arkansas, to wit:
Part of the Southwest Quarter (SW1/4) of the Southeast Quarter (SE1/4) of Section 28, Township 19 North, Range 15 West, Marion County, Arkansas, described as follows: From the Northwest corner of said SW1/4 SE1/4 of Section 28, the Point of Beginning of the tract being described, go South 88° 31’ 28” East 1333.71 feet to the Northeast corner of said SW1/4 SE1/4; then go along the east boundary of said SW1/4 SE1/4 South 01° 06’ 05” West 743.41 feet to a one-half inch rebar; then go North 88° 33’ 23” West 490.13 feet to a 3/8 inch rebar; then go North 01° 26’ 37” East 466.69 feet to a 3/8 inch rebar; then go North 88° 33’ 23” West 848.02 feet to a one-half inch rebar on the west boundary of said SW1/4 SE1/4; then go North 01°26’ 37 East 277.45 feet to the Point of Beginning, containing 13.73 acres.
Also a 20 foot non-exclusive easement for ingress, egress, and utilities described as follows: Beginning at the Southwest corner of the SW1/4 SE1/4, Section 28, Township 19 North, Range 15 West, then go North along the West line of said forty to a point on the South line of the above described tract, then leave the West forty line and go East along the South line of the above described tract 20 feet to a point, then go South, parallel with the West line, to a point on the South line of said forty, then go West, along the South line of the forty, 20 feet to the Point of Beginning.
Such sale will be held at the south door of the Marion County Courthouse in Yellville, AR on Tuesday, July 14, 2026, at 10:00 a.m.
Sale will be to the highest bidder for cash in hand in the amount of the purchase price or on a credit of three months. All bidders must be pre-qualified subject to Petitioner’s and Commissioner’s approval. Prior to the commencement of the sale, all cash buyers must present a certified cashier’s check in the full amount of his/her/its bid, and all other bidders must present a letter of credit from a reputable lending institution subject to the approval of Petitioner and Commissioner. Bidders requiring financing must pay a deposit of 10% of the purchase price in cash or certified funds to the Commissioner at the time of sale and execute a proper bond, with security to be approved by the Petitioner, for payment of the balance of the purchase price payable together with interest at 10% per annum from date of sale until paid, with a lien being retained on the premises sold to secure the payment of the purchase money. The 10% deposit is nonrefundable and will be forfeited in the event the successful bidder fails to complete the purchase. The property will be sold subject to any real property taxes or assessments due on the property, and filing fees and costs of sale (including, but not limited to, publication costs and Commissioner’s fees) shall be paid by the purchaser at said sale.
