Johnson, Jr., wife and husband executed a Mortgage in favor of Vanderbilt Mortgage and Finance, Inc., which was recorded on December 10, 2014 as Instrument Number 2014R-04341, in the real estate records of Poinsett County, Arkansas. On October 31, 2005, Pearlie M. Gilmore and Wynette L. Gilmore, executed a security instrument in favor of Jim Walter Homes, Inc., which was recorded on January 17, 2006, as Instrument No. 06-0123 in the real estate records of Poinsett County, Arkansas and is now held by The Bank of New York Mellon, as Indenture Trustee, for Mid-State Capital Corporation 2006-1 Trust.
The default for which foreclosure is made is due to the failure of payment per the terms of the note and security instrument and is now wholly due. Mortgagee or Beneficiary is exercising its power of sale under Ark. Code Ann.
