NOTICE OF PUBLIC HEARINGS
The Arkansas Pollution Control and Ecology Commission (APC&EC) will hold public hearings at North Little Rock September 30, 2014, to receive public comments on proposed revisions to Commission Regulations 29 (Brownfields Redevelopment) and 30 (Remedial Action Trust Fund/Hazardous Substances Site Priority List). The Regulation 29 hearing will begin at 2:00 p.m. in the Commission Room at the Arkansas Department of Environmental Quality (ADEQ) headquarters building, 5301 Northshore Drive, North Little Rock, and will be immediately followed by the Regulation 30 hearing.
The deadline for submitting written comments on the proposed changes to both regulations is 4:30 p.m. (Central Time) October 14, 2014.
In the event of inclement weather or other unforeseen circumstances, a decision may be made to postpone the hearings. If the hearings are postponed and rescheduled, a new legal notice will be published to announce the details of the new hearing date and comment period for both regulations.
Commission authority for revising Regulation 29 is found in the Arkansas Code, Annotated (ACA), Section 8-7-209 (b) (1), and authority for revising Regulation 30 is found in the ACA, Section 8-7-501, et seq.
Regulation 29 deals with procedures for the cleanup and redevelopment of contaminated sites for productive re-use. Proposed revisions to Regulation 29 involve minor changes in various sections of the regulation text to conform to APC&EC regulation style and format changes adopted by the Commission since the last time Regulation 29 was revised in 2006.
Regulation 30 establishes the state Hazardous Substances Site Priority List (SPL), which identifies Arkansas locations with hazardous substance issues which have been authorized for funding by the state Hazardous Substances Remedial Action Trust Fund for assessment and possible remedial action.
Proposed changes to Regulation 30 include deletion of three sites from the current listing because remedial actions at the locations have been performed to the extent that the sites no longer pose an unacceptable risk to human health or the environment; adding a new site to the SPL for investigation, characterization, and remediation as may be needed; and transferring one site from the SPL to the National Priority List (NPL) administered by the U.S. Environmental Protection Agency.
Sites proposed for deletion from the SPL are:
• Arkansas Waste to Energy Warehouse, 420 West Parsons Drive, Osceola, Mississippi County.
• I Can, Inc., 420 East Academy Street, Lonoke, Lonoke County.
• Thompson Scientific Industries, 1605 River Port Road, Scranton, Logan County.
The new facility proposed for addition to the SPL is 49ers Resource Recovery and Forty-Nine Metals Management, LLC., 4722 U.S. Highway 49 North, Paragould, Green County.
The facility proposed to be transferred from the SPL to the NPL is MacMillan Ring Free Oil, also known as Norphlet Chemical Co., 600 MacMillan Road (or State Highway 335 and MacMillan Road), Norphlet, Union County.

Oral and written comments will be accepted at the hearings, but written comments are preferred in the interest of accuracy. The facility under consideration is located as follows: 5800 Frozen Road, Little Rock, in Pulaski County, Arkansas.
Proposed Construction will include addition of two Advantex AX-20 filtration pods, and associated pumps, piping, and controls, for optional polishing of wastewater from the existing oil/water separator. Effluent from the pods will be recirculated through the trench drain system back to the oil/water separator. There is no change to the design flow. The existing treatment system is oil/water separator with a variable design flow.

Under the provisions of Act 163 of the 1993 Arkansas Legislature, this is to give notice the Water Division of the Arkansas Department of Environmental Quality (ADEQ) received an application on 8/22/2014, for the modification of NPDES Permit AR0052191 and State Construction Permit No. AR0052191C from the following facility:

The facility under consideration is located as follows: 5800 Frozen Road, Little Rock, in Pulaski County, Arkansas.
Proposed Construction will include addition of two Advantex AX-20 filtration pods, and associated pumps, piping, and controls, for optional polishing of wastewater from the existing oil/water separator. Effluent from the pods will be recirculated through the trench drain system back to the oil/water separator. There is no change to the design flow. The existing treatment system is oil/water separator with a variable design flow.

Pursuant to A.C.A. §8-4-203, and the regulations promulgated thereunder, the Air Division of the Arkansas Department of Environmental Quality gives the following notice:
Tyson Foods, Inc. (64-00001) operates a facility located at 442 Plant Street, Waldron, AR 72958. This facility has submitted an application for a minor source air permit in order to add manganese as a permitted emission according to 40 CFR Part 63, Subpart DDDDDDD — National Emission Standards for Hazardous Air Pollutants for Area Sources: Prepared Feeds Manufacturing.
The application has been reviewed by the staff of the Department and has received the Department’s tentative approval subject to the terms of this notice.

Treated Materials Co., Inc. (13•00257) operates a facility located at 6040 Highway 79 N, Rison, AR 71665. This facility has submitted an application for a minor source permit for a facility that pressure treats light poles with pentachlorophenol and chromated copper chrome arsenate. The primary emissions include 1.2 tons per year (tpy) PM, 11.7 tpy VOC, 6.3 tpy CO, 7.5 NOx and 1.2 tpy of total HAPs.
The application has been reviewed by the staff of the Department and has received the

This facility, which previously operated under General Air Permit for Minor Source Rock Crushing Facilities, 1916-AGP-019, has submitted an application to obtain a Minor Source Air Permit. Permitted emissions are 80.8 tons/year (tpy) PM¬, 29.5 tpy PM¬10, 3.8 tpy SO¬2, 1.0 tpy VOC, 12.2 tpy CO, 56.2 tpy NOx, and 0.05 tpy Total HAPs.

Pursuant to the Arkansas Operating Air Permit Program (Regulation #26) Section 602, the Air Division of the Arkansas Department of Environmental Quality gives the following notice:
DeSoto Gathering Company, LLC (Phillips Mountain CPF-1) (15-00590) operates a facility located at 3774 Hwy 287, Cleveland, AR 72030. This facility has submitted an application to renew the facility’s Title V permit, incorporated the applicable provisions of NSPS OOOO, include emission limits for trace HAPs emitted by combustion of natural gas at the facility, allow for the interchangeability of the G3516 and the G3516b ULB compressor engines, and updated the insignificant activities list. The total permitted emission increases include 1.5 tpy of VOC, 2.1 tpy of CO, 3.1 tpy of NOx, 0.59 tpy of Benzene, and 8.98 tpy of Other HAPs. The total permitted emission decreases include 0.18 tpy of H2S.
The application has been reviewed by the staff of the Department and has received the Department’s tentative approval subject to the terms of this notice.
