ACTIONS
Public notice is hereby given that the Arkansas Department of Environmental Quality (ADEQ) has entered into the Consent Administrative Orders and has issued the Notices of Violation listed below. Documents for these enforcement matters can be made available for inspection or copying by contacting ADEQ's Legal Division, 5301 Northshore Drive, North Little Rock, Arkansas 72118-5317. There may be a charge to cover photocopying costs for some documents. Copies of enforcement documents, including those referenced in this notice, also are available for viewing on the ADEQ website at http://www.adeq.state.ar.us/legal/cao_info.asp. Further, ADEQ is accepting written comments from the public regarding these matters. Such comments must be sent to ADEQ, Legal Division, at the above address within 30 days after publication of this Notice. If a comment on any proposed Consent Administrative Order is received by ADEQ within this time period, in accordance with Act 163 of 1993, the person submitting the comment may request the Arkansas Pollution Control and Ecology Commission to set aside the order in the matter by filing a petition with the Commission Secretary. If a comment on any Notice of Violation is received by ADEQ within this time period, the person submitting the comment will be given notice of any hearings held on the matter and shall have the right to intervene in any hearing in the matter by filing a petition for intervention with the Commission Secretary. NOTICE OF PUBLIC HEARINGS
The Arkansas Pollution Control and Ecology Commission (APC&EC) will hold public hearings at North Little Rock September 30, 2014, to receive public comments on proposed revisions to Commission Regulations 29 (Brownfields Redevelopment) and 30 (Remedial Action Trust Fund/Hazardous Substances Site Priority List). The Regulation 29 hearing will begin at 2:00 p.m. in the Commission Room at the Arkansas Department of Environmental Quality (ADEQ) headquarters building, 5301 Northshore Drive, North Little Rock, and will be immediately followed by the Regulation 30 hearing.
The deadline for submitting written comments on the proposed changes to both regulations is 4:30 p.m. (Central Time) October 14, 2014.
In the event of inclement weather or other unforeseen circumstances, a decision may be made to postpone the hearings. If the hearings are postponed and rescheduled, a new legal notice will be published to announce the details of the new hearing date and comment period for both regulations.
Commission authority for revising Regulation 29 is found in the Arkansas Code, Annotated (ACA), Section 8-7-209 (b) (1), and authority for revising Regulation 30 is found in the ACA, Section 8-7-501, et seq.
Regulation 29 deals with procedures for the cleanup and redevelopment of contaminated sites for productive re-use. Proposed revisions to Regulation 29 involve minor changes in various sections of the regulation text to conform to APC&EC regulation style and format changes adopted by the Commission since the last time Regulation 29 was revised in 2006.
Regulation 30 establishes the state Hazardous Substances Site Priority List (SPL), which identifies Arkansas locations with hazardous substance issues which have been authorized for funding by the state Hazardous Substances Remedial Action Trust Fund for assessment and possible remedial action.
Proposed changes to Regulation 30 include deletion of three sites from the current listing because remedial actions at the locations have been performed to the extent that the sites no longer pose an unacceptable risk to human health or the environment; adding a new site to the SPL for investigation, characterization, and remediation as may be needed; and transferring one site from the SPL to the National Priority List (NPL) administered by the U.S. Environmental Protection Agency.
Sites proposed for deletion from the SPL are:
• Arkansas Waste to Energy Warehouse, 420 West Parsons Drive, Osceola, Mississippi County.
• I Can, Inc., 420 East Academy Street, Lonoke, Lonoke County.
• Thompson Scientific Industries, 1605 River Port Road, Scranton, Logan County.
The new facility proposed for addition to the SPL is 49ers Resource Recovery and Forty-Nine Metals Management, LLC., 4722 U.S. Highway 49 North, Paragould, Green County.
The facility proposed to be transferred from the SPL to the NPL is MacMillan Ring Free Oil, also known as Norphlet Chemical Co., 600 MacMillan Road (or State Highway 335 and MacMillan Road), Norphlet, Union County.

Copies of the proposed changes to both regulations are available for public inspection during regular business hours at the ADEQ’s Little Rock office in the Customer Service Division, located in Building D, 8101 Interstate 30, or ADEQ information depositories located in public libraries at Arkadelphia, Batesville, Blytheville, Camden, Clinton, Crossett, El Dorado, Fayetteville, Forrest City, Fort Smith, Harrison, Helena, Hope, Hot Springs, Jonesboro, Little Rock, Magnolia, Mena, Monticello, Mountain Home, Pocahontas, Russellville, Searcy, Stuttgart, Texarkana, and West Memphis; in campus libraries at the University of Arkansas at Pine Bluff and the University of Central Arkansas at Conway; or in the Arkansas State Library located on the State Capitol grounds at Little Rock.
Oral and written comments will be accepted at the hearings, but written comments are preferred in the interest of accuracy. In addition, written and electronic mail comments will be considered if received no later than 4:30 p.m. (Central Time) October 14, 2014. NOTICE OF PUBLIC HEARINGS
The Arkansas Pollution Control and Ecology Commission (APC&EC) will hold public hearings at North Little Rock September 30, 2014, to receive public comments on proposed revisions to Commission Regulations 29 (Brownfields Redevelopment) and 30 (Remedial Action Trust Fund/Hazardous Substances Site Priority List). The Regulation 29 hearing will begin at 2:00 p.m. in the Commission Room at the Arkansas Department of Environmental Quality (ADEQ) headquarters building, 5301 Northshore Drive, North Little Rock, and will be immediately followed by the Regulation 30 hearing.
The deadline for submitting written comments on the proposed changes to both regulations is 4:30 p.m. (Central Time) October 14, 2014.
In the event of inclement weather or other unforeseen circumstances, a decision may be made to postpone the hearings. If the hearings are postponed and rescheduled, a new legal notice will be published to announce the details of the new hearing date and comment period for both regulations.
Commission authority for revising Regulation 29 is found in the Arkansas Code, Annotated (ACA), Section 8-7-209 (b) (1), and authority for revising Regulation 30 is found in the ACA, Section 8-7-501, et seq.
Regulation 29 deals with procedures for the cleanup and redevelopment of contaminated sites for productive re-use. Proposed revisions to Regulation 29 involve minor changes in various sections of the regulation text to conform to APC&EC regulation style and format changes adopted by the Commission since the last time Regulation 29 was revised in 2006.
Regulation 30 establishes the state Hazardous Substances Site Priority List (SPL), which identifies Arkansas locations with hazardous substance issues which have been authorized for funding by the state Hazardous Substances Remedial Action Trust Fund for assessment and possible remedial action.
Proposed changes to Regulation 30 include deletion of three sites from the current listing because remedial actions at the locations have been performed to the extent that the sites no longer pose an unacceptable risk to human health or the environment; adding a new site to the SPL for investigation, characterization, and remediation as may be needed; and transferring one site from the SPL to the National Priority List (NPL) administered by the U.S. Environmental Protection Agency.
Sites proposed for deletion from the SPL are:
• Arkansas Waste to Energy Warehouse, 420 West Parsons Drive, Osceola, Mississippi County.
• I Can, Inc., 420 East Academy Street, Lonoke, Lonoke County.
• Thompson Scientific Industries, 1605 River Port Road, Scranton, Logan County.
The new facility proposed for addition to the SPL is 49ers Resource Recovery and Forty-Nine Metals Management, LLC., 4722 U.S. Highway 49 North, Paragould, Green County.
The facility proposed to be transferred from the SPL to the NPL is MacMillan Ring Free Oil, also known as Norphlet Chemical Co., 600 MacMillan Road (or State Highway 335 and MacMillan Road), Norphlet, Union County.

Oral and written comments will be accepted at the hearings, but written comments are preferred in the interest of accuracy.
